All returned goods will not be accepted without prior written authorization. Upon inspection and approval of returned items, the terms of credit are as follows:
1. EquipAll will accept return of goods that are defective, or shipped in error for full credit.
2. Returned goods accepted by EquipAll may be subject to a minimum 20% handling charge.
3. EquipAll will not accept return of any merchandise which is specially fabricated in any way.
4. All returns must be freight prepaid; goods sent freight collect will have freight charged back to their account.
5. A copy of the invoice must accompany the return goods.
Order cancellation requests may be subject to a 20% charge if the orders have been picked and packaged. If the order has already shipped please refer to the Return Policy above.
Claims for lost or damaged goods should be placed with the carrier. EquipAll IS NOT RESPONSIBLE for merchandise lost/damaged in transit. Our responsibility ends when goods have been consigned and accepted by a carrier. All claims for any shortage or error in the order must be fully detailed and presented in writing within ten days after receipt of shipment.
IN NO EVENT SHALL EQUIPALL, ITS SUBSIDIARIES OR AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, OR AGENTS BE LIABLE FOR DIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR INDIRECT DAMAGES (INCLUDING BUT NOT LIMITED TO, LOSS OF DATA, USE, OR PROFITS), HOWEVER CAUSED, WHETHER FOR BREACH OF CONTRACT, NEGLIGENCE, OR OTHERWISE, AND WHETHER OR NOT THIS COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF ANY SUCH DAMAGES. YOU AGREE THAT THE COMPANY PARTIES MAXIMUM LIABILITY ARISING FROM ANY PRODUCT SOLD SHALL NOT EXCEED THE PRICE OF SUCH PRODUCT. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF EXCLUSION OF LIABILITY FOR CERTA1N DAMAGES SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU TO THE EXTENT SUCH JURISDICTIONS LAW IS APPLICABLE TO THIS AGREEMENT.
